Abstract

Abstract: The rapid development of Artificial Intelligence (AI) has created opportunities for its application in notarial practice, particularly in the process of verifying the identity of appearers. This study aims to analyze the legal status of AI utilization in identity verification and its implications for the authenticity of notarial deeds under Indonesian positive law. The research employs a normative legal method using statutory, conceptual, and analytical approaches. The findings indicate that the use of AI as a supporting verification tool is legally permissible, provided that it is implemented during the physical meeting between the notary and the appearer, thereby preserving the authenticity requirements of a notarial deed as stipulated in Article 1868 of the Indonesian Civil Code. However, the legal responsibility of the notary remains absolute and cannot be delegated to an AI system. Accordingly, AI implementation must follow a Dual Verification mechanism that combines AI-based digital verification with the notary's independent professional assessment. Furthermore, the absence of specific regulations governing AI in notarial practice creates legal uncertainty, highlighting the urgent need for comprehensive legal regulations to ensure legal certainty and accountability in the use of AI within the notarial profession.

Abstrak: Perkembangan Artificial Intelligence (AI) membuka peluang penerapannya dalam proses verifikasi identitas penghadap pada praktik kenotariatan. Penelitian ini bertujuan menganalisis kedudukan hukum penggunaan AI dalam verifikasi identitas serta implikasinya terhadap keotentikan akta notaris berdasarkan hukum positif Indonesia. Penelitian menggunakan metode hukum normatif dengan pendekatan perundang-undangan, konseptual, dan analitis. Hasil penelitian menunjukkan bahwa penggunaan AI sebagai instrumen bantu verifikasi dapat dibenarkan sepanjang dilakukan bersamaan dengan pertemuan fisik antara notaris dan penghadap, sehingga tidak mengurangi keotentikan akta sebagaimana diatur dalam Pasal 1868 KUH Perdata. Namun demikian, tanggung jawab hukum notaris tetap bersifat penuh dan tidak dapat dialihkan kepada sistem AI, sehingga diperlukan mekanisme Verifikasi Ganda (Dual Verification) yang mengombinasikan verifikasi berbasis AI dengan pemeriksaan langsung oleh notaris. Penelitian ini juga menegaskan pentingnya pembentukan regulasi khusus mengenai penggunaan AI dalam jabatan notaris guna memberikan kepastian hukum.
