ANALISIS PERZINAHAN DALAM KERANGKA HUKUM PIDANA PUTUSAN NOMOR. 222/PID.B/2021/PN BONDOWOSO

Abstract

Marriage is an important stage for humans, marking the beginning of a merried life to achieve the goal of a harmonious, loving, and compassionate family. However, not all marriages go as expected; sometimes couples have to divorce for certain reasons, such as adultery. For example, the viral case in Bondowoso, where an online motorcycle taxi driver was involved in affair that led to adultery and murder. The case has been decide by the Bondowoso District Court with Case No.222/PidB/2021/PN Bdw. To see how criminal law is applied to the perpetrator of this crime, and what were the judge’s considerations in sentencing the case? The judge found the defendant quilty and sentenced him to 1 month in prison and a fine of Rp. 5.000. the judge’s considerations were that the relationship was voluntary and repeated, there was madica evidence. From this case, it can be concluded that although the criminal and legal lement were implemented, the decision did not fulfill the element of justice for the victim because the decision was considered too light and did not provide a detterent effect and could encourage the reccurence of similar acts due to weak legal sanctions.
