Abstract

Covid-19 is a global disease first identified in Wuhan, China, spreading rapidly through droplets, attacking the respiratory system, and potentially fatal. In Indonesia, the first case was recorded on March 2, 2020. Prevention measures include handwashing, wearing masks, and maintaining physical distance. In Bondowoso, funeral refusals occurred due to a lack of knowledge about mortuary protocols. The research emphasizes the importance of education, including webinars, to improve public understanding and prevent transmission as well as stigma toward Covid-19 victims. This study uses a normative legal method based on literature review, examining regulations related to the handling of Covid-19 victims’ bodies and their application in the funeral refusal cases in Bondowoso. The analysis covers the compatibility of procedures with applicable laws and prevailing social norms. The refusal of Covid-19 burials in Bondowoso was triggered by stigma, fear, and lack of understanding of procedures, despite official regulations ensuring safety. Legally, such refusals violate the Criminal Code and the Law on Infectious Disease Outbreaks, though the penalties are considered light. Additional obstacles arise from limited facilities and “infodemics.” The solution requires strict law enforcement, education, adequate facilities, and the involvement of local community leaders.
