Abstract

This study discusses the implementation of the marriage certification program by examining the perceptions of the Head of the Office of Religious Affairs (KUA) and religious leaders in Tlogosari District, Bondowoso Regency, particularly regarding the legal status of nikah siri (unregistered marriage). Religiously, nikah siri is considered valid as it fulfills the requirements of marriage; however, it has no legal force under state law because it is not registered with the KUA. Moreover, the registration of a new marriage may be rejected if one of the parties is still bound by a previous marriage, either officially registered or siri. This research employs a field study method with a descriptive-analytical approach, supported by library research. Primary data were obtained through interviews, while secondary data came from documents and related literature. Data collection techniques included interviews, observations, and documentation, which were then analyzed descriptively and qualitatively. The findings indicate that resolving the status of nikah siri must go through itsbat nikah (marriage legalization) and itsbat cerai (divorce legalization) in the Religious Court to be legally recognized. Official marriage registration is an essential step to prevent future legal and moral issues in society.
